Terms of Service

These Terms of Service ("Terms") govern your access to and use of GoNew.ai (the "Service"), operated by GONEW AI S.R.L., a Romanian limited liability company.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About us

We refer to ourselves in these Terms as "we", "us", "our", or "GoNew.ai". We refer to you as "you" or "the user".

2. What the Service does

GoNew.ai is an AI-powered career discovery platform. It provides two primary products:

• Career Shift: for adults considering a career change. You upload a CV and answer questions; an AI generates career path suggestions and supporting materials.
• Pathfinder: for young adults exploring career directions. You complete a quiz; an AI generates career direction suggestions and supporting materials.

The Service operates on a freemium model: a basic AI-generated report is available free of charge. A premium report with additional content (detailed analysis, LinkedIn profile content, cover letter template, job search links) is available for a one-time payment of EUR 4.99.

3. Eligibility

You must be at least 16 years old to use the Service. If you are between 16 and 18, you confirm that a parent or legal guardian is aware of your use.

You must have the legal capacity to enter into a contract. By using the Service, you confirm that you do.

We do not knowingly collect data from children under 16. If you believe a child under 16 has provided us with personal data, contact us at privacy@gonew.ai.

4. Your account

For some features (premium purchase, returning to access prior reports), you need an account. You agree to:

• Provide accurate information (name, email, etc.)
• Keep your login credentials confidential
• Notify us promptly if you suspect unauthorized access
• Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms.

5. The free tier and the premium upgrade

Free reports are provided at no cost. They include AI-generated career suggestions in summary form.

Premium reports cost EUR 4.99 as a one-time payment, processed by Stripe. Premium reports add detailed analysis, LinkedIn profile content drafts, a cover letter template, and job search links for the same session, accessible in your account.

Premium access is tied to the specific session for which payment was made. It is not a subscription. A separate payment is required for each session you wish to upgrade.

All prices are displayed inclusive of applicable VAT.

6. Refunds

Because the Service is a digital product delivered immediately upon payment, you expressly waive your statutory right of withdrawal under Article 16(m) of EU Directive 2011/83/EU and the corresponding provisions of Romanian Government Emergency Ordinance 34/2014, which exempts digital content delivered with the consumer's prior consent from the 14-day withdrawal period.

Notwithstanding the above, we may offer a refund as a goodwill gesture if:

• The premium report failed to generate due to a technical fault on our side
• The premium content is materially incomplete (missing core sections specified in our product description)
• You request a refund within 14 days of payment for any other reason

7. Acceptable use

You agree NOT to:

• Use the Service for any unlawful purpose
• Submit content (CV, answers, etc.) that you do not have the right to submit
• Submit content that contains malicious code, attempts to inject prompts, or attempts to manipulate AI output
• Attempt to extract, reverse engineer, or replicate the underlying AI prompts or models
• Use automated tools (scrapers, bots) to access the Service except for permitted purposes (e.g., search engine indexing of public pages)
• Resell, sublicense, or distribute reports generated by the Service except for your own personal career use
• Misrepresent yourself by submitting another person's CV without their consent
• Use the Service in a way that imposes unreasonable load on our infrastructure

8. AI-generated content disclaimer

The career suggestions, LinkedIn profile content, cover letter templates, and other outputs produced by the Service are generated by artificial intelligence. They are:

• Suggestions, not guarantees. No outcome (job offer, interview, salary) is guaranteed.
• Not professional career advice. They do not replace consultation with a qualified career counselor, recruiter, or labor market expert.
• Not financial, legal, or medical advice. Salary ranges, market projections, and similar information are estimates based on AI training data and may be inaccurate.
• Subject to error. AI systems can produce inaccurate, outdated, or contextually inappropriate output. You are responsible for reviewing all output before acting on it.

By using the Service, you acknowledge that you understand these limitations and accept full responsibility for any career decisions you make.

9. Your content

You retain ownership of all content you submit to the Service (your CV, your questionnaire answers, your free-text inputs).

You grant us a limited, non-exclusive, royalty-free license to use, process, and store this content solely for the purpose of:

• Operating the Service (generating reports for you)
• Improving the Service in aggregated, anonymized form
• Complying with legal obligations

We will not sell your CV, questionnaire answers, or generated reports to third parties.

10. Our content and intellectual property

The Service, including its design, code, AI prompts, brand, logo, and all other materials we provide, is owned by GONEW AI S.R.L. and protected by Romanian and EU intellectual property law.

Your AI-generated reports may be used by you for your own personal career purposes, including posting LinkedIn profile content on your LinkedIn profile, sharing your report with friends or family, or using the cover letter template in job applications. You may not resell or commercially distribute the generated content.

The brand name "GoNew.ai", the GoNew.ai logo, and related visual assets are trademarks of GONEW AI S.R.L. (trademark registration pending with OSIM).

11. Third-party services

The Service relies on third-party providers:

• Anthropic (PBC, USA): AI processing
• Stripe (Stripe Payments Europe Ltd., Ireland): payment processing
• Supabase (Supabase Inc., USA): database and authentication
• Vercel (Vercel Inc., USA): hosting infrastructure
• LinkedIn (LinkedIn Ireland Unlimited Company): we generate text and search URLs you can use on LinkedIn; we are not affiliated with or endorsed by LinkedIn

We choose providers carefully, but we are not responsible for the actions or outages of third parties.

12. Service availability

We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. We may suspend the Service for maintenance, upgrades, or due to events outside our control (e.g., third-party outages).

If a premium report cannot be generated due to a technical fault on our side, we will either generate it within a reasonable timeframe or refund the payment.

13. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including (but not limited to) loss of income, missed career opportunities, employment outcomes, or reliance on AI-generated suggestions.
• Our total liability to you for any claim related to the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) EUR 50.

Nothing in these Terms limits liability that cannot be limited under applicable Romanian or EU consumer protection law, including liability for gross negligence or willful misconduct.

14. Indemnification

You agree to indemnify and hold harmless GONEW AI S.R.L., its administrator, employees, and partners from any claim, demand, loss, or damage arising from:

• Your breach of these Terms
• Content you submit to the Service that infringes third-party rights
• Your misuse of AI-generated output

15. Termination

You may stop using the Service at any time. You may also request account deletion by emailing privacy@gonew.ai (this also triggers GDPR right-to-erasure — see Privacy Policy).

We may suspend or terminate your access if you breach these Terms, abuse the Service, or for any other lawful reason. We will notify you when reasonably possible.

Termination does not affect rights or obligations that accrued before termination, including payment obligations and content licenses for already-generated reports.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email (for users with accounts) and/or via a prominent notice on the Service.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, stop using the Service.

The "Last updated" date at the top of this document reflects the most recent change.

17. Governing law and disputes

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms shall first be addressed through good-faith negotiation. If negotiation fails, the dispute shall be resolved by the competent courts of Bucharest, Romania.

Nothing in this section prevents you, as a consumer, from accessing the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr, or from exercising any other rights granted to you by mandatory consumer protection law.

18. Miscellaneous

• Entire agreement. These Terms (together with the Privacy Policy and any product-specific notices) form the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce any provision is not a waiver of that provision.
• No assignment. You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are provided in English and Romanian. In case of conflict, the Romanian version prevails for users resident in Romania; the English version prevails elsewhere.

19. Career Companion subscription

Career Companion is an optional monthly subscription that extends a premium career path with application support: an Application Kit generator (a tailored CV, cover letter and interview brief for each job posting you submit), a progress roadmap with a First 90 Days plan, and one monthly progress email.

Eligibility. Career Companion requires at least one unlocked premium career path.

Price and billing. The subscription costs EUR 9.99 per month, taxes included where applicable, processed by Stripe as merchant of record. Billing is monthly, in advance, anchored to the date your paid period starts. Local currency conversion may apply at checkout.

Free trial and automatic conversion. New subscriptions start with a 7-day free trial that requires a valid payment method. If you do not cancel before the trial ends, the subscription converts automatically into a paid subscription and the first monthly fee is charged. During the trial you can generate up to 3 Application Kits. You can end the trial early from the workspace (Unlock now), in which case billing starts immediately.

Cancellation. You can cancel at any time from Settings, through the Stripe customer portal. Cancellation takes effect at the end of the current billing period (or trial). You keep access until that date. We do not offer partial or pro rata refunds for the remainder of a paid period, except where required by law (see the Refund Policy).

Fair use. Paid subscriptions include up to 30 Application Kits per calendar month. This limit protects the service from abuse and may be adjusted with notice.

Changes. We may change the subscription price or included features with at least 30 days notice by email. Price changes apply from your next billing period. If you do not agree, you can cancel before the change takes effect.
